Copyright Policy

Copyright with Ruinz Online

Ruinz Online and Dragoon Lagoon respect the value of copyrighted works. With that in mind, we would like to ask that our users share that respect and do not upload or transmit copyrighted material on our site. To help everyone with that, we have prepared this guide to copyright and our stance on the issue.

We aren't lawyers, and this is not formal legal advice.

You are also reminded that Ruinz is run as a hobbysite, formally by three people who do not as of date of writing profit from the site, and that our resources are fairly limited. We will do our best to accomodate any request in a timely manner, but we are only human.


Why should I follow copyright rules?

If you fail to respect the copyright of others, you risk serious consequences both with Ruinz Online and with the copyright holder.

Once copyright infringing material is found by our staff, it is immediately removed (without notice) and a site warning or banning will be issued, depending on whether it has happened before and the severity of the offense.

Even though Ruinz Online will remove your content, you are still legally liable for posting it. Should the original copyright owner seek to sue you, Ruinz will comply with any law in giving them your contact information.

You could lose a LOT of money in damages- copyright infringement isn't worth it! Link to a legal source if you need to share copyrighted material.


What is copyright infringement?

The following acts, and more, can be considered copyright infringement:
  • Posting content that doesn't belong to you
  • Posting content which includes elements that don't belong to you
  • Selling content that doesn't belong to you
  • Selling content which includes elements that don't belong to you

The following situations don't change the fact that it is copyright infringement:
  • Giving attribution/credit
  • Claiming 'fair use' (this is too complicated- most times it's null)
  • Whether or not you're making money from it
  • How much you've modified it

Please note that content may refer to music, videos, software, images, written work, and other things.

In some situations permission can be attained in order to post content which does not belong to you. We will accomodate realistic and / or proven instances of given permission for copyright materials (at our discretion), but these will be removed if there is a complaint and further accomodation will not be made for users who have had such complaints.

The only way to avoid copyright infringement is to come up with things that are entirely original!


My copyright / my client's copyright is being infringed upon on your site!

If you believe that one of our users is using your content without your consent, please notify us and we will remove it as soon as possible. Provide us with the following information to help us find the content and verify your copyright.
  • The signature of the alledegly infringed
  • Information on which work(s) of yours is being infringed
  • A link to where you found the infringement on the site
  • Your e-mail address (so that we can contact you)
  • A statement that you believe the work is infringing your copyright

Representatives of copyright holders use the same list with information pertaining to your client's work.

Under Section 512(f) of the Copyright Act any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability. Consult your legal counsel or see Section 512(c)(3) of 17 U.S.C. to clarify or confirm the requirements of the notice.


My content was removed from your site, but it didn't infringe on anyone's copyright!

If you believe your content was removed in error, please notify us and we will attempt to rectify the situation as soon as possible. Provide us with the following information to identify your incident:
  • Ruinz Online user account
  • Information on the work that was removed
  • A link to the topic / user gallery / account which contained the content
  • Your e-mail address (not required if you contact us through your Ruinz account- we will use the information on file)
  • An explanation of what your content was, and why it didn't infringe on copyright

We cannot guarantee that content or user accounts will be restored, but we will attempt to, in the least, explain why the content was removed.

Under Section 512(f) of the Copyright Act, any person who knowingly materially misrepresents that material or activity was removed or disabled by mistake or misidentification may be subject to liability
